Dropcall Terms of Service

Welcome to Dropcall (“the App”), operated by Picom Technologies Ltd. (Company No. 516777216), an Israeli company (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the Dropcall mobile application and any related services (collectively, the “Services”).

By downloading, accessing, or using the App, you agree to be bound by these Terms and all applicable laws. If you do not agree with these Terms, please do not use the App.



  1. Eligibility and Account Registration

1.1 Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction to use the App. By using the App, you represent that you meet these requirements.

1.2 Account Registration: Some features may require you to create an account and provide certain personal information. You agree to provide accurate, current, and complete information and to update it as necessary.

 

  1. Acceptance of Calls and Scheduling

2.1 Authorization to Make Calls: By using Dropcall, you authorize the App to make outbound calls on your behalf and schedule calls using the phone number you provide. These calls are initiated only with your permission and for your intended recipients.

2.2 No Unauthorized Use: You agree that you will not use the App to initiate unsolicited or spam calls. Any use of the App to harass, spam, or harm others is strictly prohibited.

 

  1. User Responsibilities

3.1 Lawful Use: You agree to use the App in compliance with all applicable laws, regulations, and industry guidelines.

3.2 No Spam or Unlawful Calls: You must not use the App to send unsolicited marketing messages, make fraudulent solicitations, or otherwise violate applicable spam or telemarketing laws. If we determine, in our sole discretion, that you have engaged in spam calling or other prohibited behavior, we reserve the right to suspend or terminate your account without notice.

3.3 Accuracy of Information: You are responsible for ensuring that any phone numbers you provide and any recipients you choose to call via the App are accurate and that you have the necessary permissions to contact them.

 

  1. Subscriptions and Payments

4.1 In-App Purchases and Subscriptions: Certain features of the App may require the purchase of a subscription through the Apple App Store or Google Play Store. Subscription fees and billing terms will be displayed at the time of purchase.

4.2 Payment Processing: All payments, including any refunds or billing inquiries, are handled by the applicable app store (Apple App Store or Google Play Store). If you have questions about charges, billing, or refunds, please contact the respective app store’s support.

4.3 No Refunds from Dropcall: We do not process refunds directly. Refunds, if applicable, are subject to the policies and discretion of Apple or Google.

 

  1. Access to Your Notifications

5.1 Notification Permissions: During installation and activation, the App may request access to your phone’s notification settings so we can alert you to certain events (e.g., when a call is blocked or when an SMS message is filtered).

5.2 Notification Settings: You can modify the types of notifications the App sends you via the App’s settings page.

5.3 Service Updates and Offers: From time to time, we may use notifications to inform you of important service updates, changes, or special offers related to Dropcall’s services. For more details, please see our Privacy Policy.

 

  1. New Features and Modifications to the Service

6.1 Right to Modify: We reserve the right to change, modify, or enhance the features or functionality of the Services at any time.

6.2 Updates: After installation, the App may connect to our servers periodically. We may prompt you to install updates or, in some cases, update the App automatically. Updates may occur in one or multiple sessions.

6.3 Consent to Updates: You acknowledge that we may require you to review and accept a revised version of these Terms before using any updated versions of the Services.

6.4 No Obligation to Update: You understand that we have no obligation to provide updates, additions, or newer versions of the Services. Support for earlier versions may cease once newer versions are made available.

 

  1. User Content and Consent to Use Data

7.1 User Content: Dropcall may offer you opportunities to submit audio, video, text, comments, reviews, or other content (“User Content”) through the Services, our social media pages, or third-party app store review systems.

7.2 Responsibility for User Content: You are solely responsible for any User Content you submit. You must ensure your User Content complies with these Terms and any applicable laws. You understand that uploading User Content does not create an expectation of privacy.

7.3 Monitoring: While we are not obligated to pre-screen User Content, you grant Dropcall the right (but not the obligation) to monitor, review, and remove User Content at our discretion.

7.4 License Grant: By submitting User Content, you grant Dropcall and its affiliates a worldwide, perpetual, irrevocable, non-exclusive, sub-licensable license to use, copy, transmit, distribute, publicly perform, display, and create derivative works from your User Content in all media now known or later developed. You also waive any “moral rights” or “performance rights” you may have in your User Content.

7.5 Feedback: By providing feedback (including reviews, comments, and testimonials) about the Services, you grant us the right to use, reproduce, and display that feedback (including your name, likeness, images, and testimonials) for any purpose, commercial or otherwise, without compensation to you. If you do not wish us to use your feedback for promotional purposes, please contact us at the applicable support email address listed below.

 

  1. Account Ownership

8.1 Account Holder: The owner of the phone number linked to the App on your mobile device is considered the account holder. You are solely responsible for all activity that occurs through your account.

8.2 Unauthorized Use: If you suspect unauthorized use of your account, you must notify us immediately and confirm in writing. You are responsible for maintaining the confidentiality of any password associated with your account.

8.3 Contact Information: You agree to keep your subscription and account information accurate and up-to-date. We may contact you to verify account ownership by sending a verification code or requesting proof of ownership of the account and associated number.

 

  1. Additional Subscription Services and Payments Terms

9.1 Subscription Options: You may choose a monthly or annual subscription through the Apple App Store, Google Play Store, or our websites.

9.2 Payment Processing: Payment may be processed by a third party on our behalf or directly by the platform owner (Apple or Google). Prices are listed in the App, the respective app store, or on our website.

9.3 Price Changes and Offers: Dropcall reserves the right to adjust prices and run promotions at any time. No payments are refundable in any manner.

9.4 Automatic Renewal: Subscriptions automatically renew unless canceled in accordance with these Terms.

9.5 Payment Issues: If you have payment issues after purchasing from Apple or Google, you must contact the respective store for assistance. If you subscribed via our website, please contact us at our support email.

9.6 Free Trials: Some subscriptions may start with a free trial. Unless you cancel before the trial ends, the subscription will automatically convert to a paid subscription, and you authorize automatic recurring billing to your account.

 

10.Cancellation

10.1 Canceling Through App Stores: If you purchased the App via the Apple App Store or Google Play Store, you may cancel your subscription through the store’s settings.

10.2 No Refunds: If you cancel a paid subscription, you will not receive a refund for any unused portion of the billing period.

 

  1. Intellectual Property

All content, features, and functionality (including text, graphics, logos, icons, images, code, and software) available on the App are the exclusive property of Picom Technologies Ltd. or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use. You agree not to reproduce, modify, distribute, sell, or lease any part of the App without our prior written permission.

 

  1. AI-Generated Content and Call Transcripts

Dropcall may use artificial intelligence to facilitate outbound calls and generate call transcripts. While we strive for accuracy, the AI-generated content may not be error-free. You acknowledge that the AI functionality and transcripts are provided “as is” and that we are not responsible for any inaccuracies or misunderstandings that may arise from using AI-generated features.

 

  1. Privacy

Your use of the App is also subject to our Privacy Policy, which outlines how we collect, use, and protect your information. By using the App, you agree to our Privacy Policy.

 

  1. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may also stop using the App at any time.

 

  1. Disclaimers and Limitation of Liability

The App and Services are provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, availability, or suitability of the App. To the maximum extent permitted by law, we and our affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising out of or related to your use of the App. Your sole remedy for dissatisfaction is to discontinue use of the App.

 

  1. Indemnification

You agree to indemnify, defend, and hold harmless Pico Technologies Ltd. and its affiliates, officers, agents, employees, and partners from and against all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

 

  1. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms shall be resolved exclusively by the courts located in Tel Aviv, Israel, unless otherwise required by applicable law.

 

  1. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms within the App and update the “Last Updated” date. Your continued use of the App after any modifications constitutes acceptance of the revised Terms.
